The following are the Terms and Conditions for the use of SWIFTSMS Service ("Swiftsms Service" or "the Service") by the User ("user" or "client"). Any user availing this service from www.swiftsms.in / Techraj Solutions shall invariably be bound by these Terms and Conditions.

In accordance to the Information Technology Act, 2000 (Government of India) and the common law of contract, these Terms and Conditions are valid, binding and enforceable for all persons that access the SWIFTSMS website, the web pages or any part thereof. Hence, if you do not agree to be bound over by these Terms and Conditions then you may not use the SWIFTSMS website. The reasonable use of the SWIFTSMS website shall automatically bind the user to this agreement.

SWIFTSMS provides access to its services. This is realized through an account that allows The users to send short messages (SMS) and send up to 160 characters in SMS format to the recipients defined in The users database. SWIFTSMS will attempt to deliver all of the SMS messages that The users have addressed to SWIFTSMS. Swiftsms's performance may vary in different Internet browsers. We recommend Internet Explorer 6 for using our services. In a sms ENTER (next line / return button) consumes 2 characters which might not be noticeable in some browsers.

To open an account for the usage of service, it is essential that the User must complete the registration process by providing all current, complete and accurate information as will be prompted by the Registration Form. Entering inaccurate details will result in suspension. The User is to be entirely responsible for maintaining the confidentiality regarding his password and account information. In addition, the User will be entirely responsible for any and all activities that will occur under its account. SWIFTSMS will not be held liable and respond to any third party claims and or actions taken with respect to services offered.

The users should not use the system (SWIFTSMS) for any unlawful or abusive purpose or for sending obscene, indecent, threatening, harassing, unsolicited messages affecting / infringing upon national or social interest nor create or cause any damage to any group or person(s).

The users agree that they are responsible for the Content of messages that The user submit, and The users, not SWIFTSMS (Services), have responsibility for the Content, including its legality, reliability, appropriateness, originality and copyright. The users agree to not use the Services to intentionally or Un intentionally violate any applicable local, state, national or international law, or any regulations having the force of law. A recipient that does not wish to receive SMS messages services including advertisements or promotions and states this clearly to SWIFTSMS (Services) or The users, has to be removed from the system list. The user may not send to same client but in future. Any user found violating the T&C is liable for action under the prevailing laws including termination / suspention of services without any prior notice. Incase of termination / suspention SWIFTSMS reserves the sole rights for refund process and timeline.

The billing system is agreed to be prepaid.

You, the User of the service, understand and agree that it is your responsibility to consume the service within validity period offered to you, else the service will lapse after the validity period. In any case, maximum validity period of the service cannot exceed 1-year from the date of placing confirmed order against payment, after which the service will lapse.

You, the User of the service, understand and agree that telecom operators can increase the price of services at anytime, and such increase being beyond the control of Techraj Solutions, Techraj Solutions can pass on such increase to you, fully or partially, by way of levying additional charges and /or deduction of proportionate credits from your account with Techraj Solutions.

You, the User of the service, agree and understand that Interconnect charges, if applicable in future or in retrospect on any Indian or supporting overseas network, shall be charged extra and adjusted in the prepaid amount by Techraj Solutions.

You, the User of the service, understand and agree that Msandesh do-not have any cancellation policy. Hence kindly test our services well before opting.

You, the User of the service, agree and understand that No refunds will be made in any case. Our Charges include collective fees like branding (Sender Name/Number) fees, one-time setup fees, license/subscription fees, monthly administration fees and any other such fees that the User may have paid to Techraj Solutions.

SWIFTSMS (Services) reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services (or any party thereof).

The users use of the Services is at The users sole risk. The Services and information as defined under SWIFTSMS (Services) are provided on an "as is" and "as available" basis. SWIFTSMS(Services) makes no representations, warranties, or guaranties as to the quality, suitability, truth, accuracy or completeness of any of the Content transmitted via the Services. Any disputes arising under this agreement will be subject to Jurisdiction at Ahmedabad (India).

Under no circumstances can SWIFTSMS (Services) guarantee the delivery of messages. SWIFTSMS (Services) is not liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary Damages caused by, but not limited to, delayed or failed delivery of short messages (SMS).

Prices & validity are subject to change according to governments guidelines, operator charges, etc without any prior notice.

(a) SWIFTSMS (Services) makes no warranty that:

• The Services will meet The users requirements
• The Services will be uninterrupted, timely, secure, or error-free
• The results that may be obtained from the use of the Services will be accurate or reliable.

(b) Any material obtained through the use of the Services is done at The users own discretion and risk and The users are solely responsible for any damage to The users computer system or loss of Data that results from the download of such material.

(c) No advice or information, whether oral or written, obtained by The users from SWIFTSMS (Services) will create any warranty not expressly stated in the terms of this Agreement. www.swiftsms.in / www.swiftsms.in shall take all reasonable steps to secure the content of the www.swiftsms.in / www.swiftsms.in website and to secure the information provided by and collected from Users to prevent unauthorized access and/or disclosure. However, www.swiftsms.in / www.swiftsms.in do not make any warranty or representation that the said content shall be 100% safe or secure.
